Dana Loesch endorses Missouri's discriminatory ballot measure #SJR39


Yet another anti-LGBTQ religious exemptions bill in the news, and it's Missouri's SJR39, and of course, a certain conservative yakker who hosts a show on TheBlaze on the TV side and on KFTK/Radio America for the radio side is going out of her way to defend this bigoted bill.

SJR 39, introduced by State Sen. Bob Onder (R-St. Charles), would ask voters to prohibit the state from imposing a penalty on a religious organization or individual who acts in accordance with a sincere religious belief concerning same-sex marriage, which includes the refusal to perform a same-sex marriage ceremony or allow a same-sex wedding ceremony to be performed on the religious organization's property. The bill further says the state shall not impose a penalty on an individual who declines either to be a participant in a marriage or wedding ceremony or to provide goods or services of expressional or artistic creation for such a marriage or ceremony or an ensuing celebration thereof, because of a sincere religious belief concerning marriage between two persons of the same sex.

Dana Loesch's atrocious excuse-making for defending Indiana's license to discriminate law


Anti-LGBTQ demagogue Dana Loesch defense another state's horrible anti-LGBTQ "religious freedom" (aka license to discriminate) law, and this time, it's Indiana's idiotic SB101 that was recently signed into law by Indiana Governor and potential 2016 GOP Presidential candidate Mike Pence.

Just a side note: Indianapolis is where KFTK and WIBC's corporate owner Emmis Communications is based at, and The Dana Show aired on those two stations prior to going nationally syndicated with Radio America in 2014.

She has attacked Angie's List, Wilco, and others who dared to boycott Indiana over the passage of SB101.

The Indiana law differs substantially from the federal Religious Freedom Restoration Act, signed by President Clinton in 1993, and all other state RFRAs.

There are several important differences in the Indiana bill but the most striking is Section 9. Under that section, a “person” (which under the law includes not only an individual but also any organization, partnership, LLC, corporation, company, firm, church, religious society, or other entity) whose “exercise of religion has been substantially burdened, or is likely to be substantially burdened” can use the law as “a claim or defense… regardless of whether the state or any other governmental entity is a party to the proceeding.”

Every other Religious Freedom Restoration Act applies to disputes between a person or entity and a government. Indiana’s is the only law that explicitly applies to disputes between private citizens.* This means it could be used as a cudgel by corporations to justify discrimination against individuals that might otherwise be protected under law. Indiana trial lawyer Matt Anderson, discussing this difference, writes that the Indiana law is “more broadly written than its federal and state predecessors” and opens up “the path of least resistance among its species to have a court adjudicate it in a manner that could ultimately be used to discriminate…”Click to enlarge CREDIT: DYLAN PETROHILOS/THINKPROGRESS

This is not a trivial distinction. Arizona enacted an RFRA that applied to actions involving the government in 2012. When the state legislature tried to expand it to purely private disputes in 2014, nationwide protests erupted and Jan Brewer, Arizona’s Republican governor, vetoed the measure.

Remember that the Indiana RFRA is VASTLY DIFFERENT than the other 19 states that have such laws and the federal one.
















It's not just Indiana that's proposing and/or passing RFRA bills in the vein of the now-vetoed Arizona SB1062 and recently passed and signed into law Indiana SB101: Georgia, North Carolina, and Arkansas-- to name a few, are considering such bills.

Fake "Christian" Homophobic Extremist Dana Loesch defends odiously anti-LGBTQ Arizona SB1062

Crass homophobic idiot Dana Loesch has defended Arizona's odious SB1062 bill that discriminates against LGBTQ folks, a bill that BOTH of Arizona's GOP Senators (McCain and Flake) and 2012 GOP Presidential nominee Mitt Romney want vetoed, along with many businesses and the Super Bowl Committee.

Arizona's Republican Governor Jan Brewer is almost certainly expected to veto the bill, which should render the bill dead; however, SB1062 still could get potentially passed via a veto override of 2/3rds of both the House and Senate of that state.

Should non-religious businesses operating in the private market be forced to serve the public regardless of race, religion, veteran status, disability, etc.? That's the issue conservative radio host Dana Loesch addressed on Twitter last night as she discussed Arizona's controversial SB 1062 - deemed the 'license to discriminate' act. Despite massive conservative resistance to the legislation, the ever-controversial Loesch still seems to believe (and promote) the concept that business owners should be able to refuse service not just to LGBT people, but to anyone they want. 

Over the course of several tweets to her official Twitter account last night, she laid out her argument stating at one point that it is "Truly shocking how many people think that the government has the right to force another person to use their talents for state decree." She continued, "I'd support the right of a gay baker to refuse the Westboro cult a cake. Their labor, their choice. This is freedom." 

As most people are aware, the latter would be in violation of Title II of the Civil Rights Act's prohibition on religious discrimination in places of public accommodation; but that's the point of her hyperbolic argument though. By taking the idea of being allowed to refuse service to its absolute extreme, Loesch hopes her attempts to attack the civil rights of everyday LGBT citizens in Arizona won't seem crass and overstated. She wants to seem like the hero in defending the very same arguments used by Jim Crow era segregationists. 


This is not surprising, given her anti-LGBTQ animus that she has displayed in the past.
